Clobber Media – Terms of Purchase & Copyright Agreement

By purchasing or commissioning creative services, media, or works (“Work”) from Clobber Media, you (“Client”) agree to the following:

1. Terms of Purchase
All payments, deposits, and due dates will be clearly specified in an invoice, proposal, or written agreement.
Work will not commence until the required payment or deposit has been received.
All purchases and commissions are final. Refunds are only considered if no work has started and are at Clobber Media's sole discretion.
Project scope, deliverables, and revision limits will be established before work begins. Any additional revisions or scope changes may incur extra charges.

2. Right of Refusal

  • Clobber Media reserves the right to refuse or discontinue any project that is deemed:

    • Offensive, defamatory, discriminatory, harmful, or illegal.

    • Outside the studio’s creative or professional scope.

  • If a project is declined before work begins, the Client will receive a refund (minus applicable transaction fees).

  • If work has begun, Clobber Media reserves the right to stop work. Any refunds (if applicable) will be determined at our discretion, based on the amount of work completed.

3. Limited Copyright & Usage Rights

  • Unless otherwise agreed in writing, all commissioned Work is considered “work for hire.”

    • The Client is granted usage rights (personal or commercial, as agreed).

    • Clobber Media retains limited rights to use completed Work for:

      • Portfolio display (website, social media, or printed portfolio).

      • Advertising and promotional purposes.

      • Examples of prior commissions.

  • Restrictions on Reproduction and Merchandise:

    • The Client may not reproduce, resell, or merchandise the Work without a separate written agreement.

    • Any rights beyond the originally agreed usage must be negotiated in a new contract.

4. Attribution

  • When feasible, the Client agrees to provide credit to Clobber Media (or applicable sub-brand, such as Soft Muse Studio or Adeptus Acrylicus). Attribution requirements may be waived in writing.

5. Acceptance of Terms

By initiating a purchase or commission with Clobber Media, the Client acknowledges they have read, understood, and agreed to these Terms.
